Bergsala had been able to find a copyright that hadn't been used in Sweden ever before. The law said that all renting and with that comparable act is prohibited by law if you don't have the originators agreement.
The comparable act should in this case be our trading with the used games and the originator was Bergsala who had the license for selling Nintendogames in Sweden. Bergsala claimed that we infringed on their copyright by trading games. We bought and sold TV-games and yes, if the customer sold one game to us and at the same time bought a new one, then he had done a trade, but we had made no rule which said that he had to come back with the same game which he had bought. No, he could do whatever he wanted with his game. I didn't believe that this was comparable with renting and I stacked to that point of view.
Bergsala soon came with a concept were it was "legal" to deal with the used Nintendogames. You were to be a "licensed trader" and get a sign in your window witch said that you were approved by Nintendo. And to be approved you had to buy a package of old games for about 10 000 crones (1400 US$) and also pay 15 % of your sale to Bergsala. If you refused to sign this agreement you should either be forced to close down your business or be reported to the police.
And so it happened with Gameland. We were chosen to be a precedence case, the case was first to be tried against us and if the sentence then came to Bergsalas behalf, the rest of, at that time, 100 second hand stores should be forced to pay. Why they picked Gameland I don't know, I think it had to do with that we constantly opposed their propaganda and also that we were growing fast with plans on opening stores in Landskrona and Helsingborg, two cites in southern Sweden.
Of course we thought it was stupid with this new ideas from Bergsala. We had been going on for more than a year, it went on good and everybody were satisfied. Second hand business had always been a common thing and how could they compare this with renting. Besides this we bought new things from Bergsala for a great deal of money.
I wasn't interested of buying old games for 10 000 crones and absolutely not of giving Bergsala 15% of our sale, how should we survive then? I sow this only as new terror from Bergsala and just another attempt to earn more money.
